01These terms

These terms and conditions are between you and PartnerPips.com (“PartnerPips”, “we”, “us”). They govern your access to and use of this website and any partnership enquiry you submit through it.

By using the site you accept these terms. If you do not accept them, please do not use the site. Our Privacy Policy and Cookie Policy form part of these terms.

02What PartnerPips is — and is not

PartnerPips is a partnership and Introducing Broker network. What we do is make introductions: connecting Forex and CFD brokers with Introducing Brokers, affiliates, trading communities and other commercial partners, and helping both sides judge whether there is a sensible fit.

Nothing on this website is, or should be read as:

• Investment, financial, legal, tax or trading advice
• A personal recommendation, or an assessment of whether any product is suitable or appropriate for you
• An offer, solicitation or inducement to buy, sell or trade any financial instrument
• A representation about the regulatory status, financial standing, solvency or conduct of any broker or partner
• A promise, projection or guarantee of income, commission, profit, business volume or trading performance

Figures and visuals shown on our website — including any illustrative statistics, charts and network diagrams — are for presentation only. They describe the shape of a partnership network, not trading results, and must not be read as performance data.

03Who may use this site

This site is intended for businesses and professionals: brokers, Introducing Brokers, affiliates, trading communities, financial marketers and comparable commercial partners. It is not aimed at retail consumers seeking trading services.

By using the site you confirm that you are at least 18 years old, that you have authority to act for any organisation you name, and that your use of the site and any partnership you pursue is lawful where you are located and where you operate. You are responsible for determining whether the activity you are proposing requires a licence, registration or regulatory permission in your jurisdiction, and for obtaining it.

We may decline to work with any person or organisation, and may restrict access to the site, at our discretion.

04Partnership enquiries

Submitting the enquiry form starts a conversation. It does not create a partnership, an agency, a joint venture or an employment relationship, and it does not oblige either of us to enter into any agreement.

We are under no obligation to respond to, accept or progress any enquiry, and we may decline one without giving reasons. Any partnership that does follow will be governed by a separate written agreement between the parties; where that agreement conflicts with these terms, that agreement prevails for the subject matter it covers.

You agree that the information you submit is accurate, current and complete, that you are entitled to provide it, and that you will keep us informed if it changes materially while we are in discussion.

05Brokers, partners and third-party sites

Brokers and other organisations in our network are independent businesses. They set their own terms, commercial arrangements, pricing and conditions, and they are responsible for their own conduct, regulatory standing and obligations to their clients.

This site may link to third-party websites. We do not control them, we do not endorse them, and we are not responsible for their content, products, services or practices. Visiting them is at your own risk and subject to their terms.

06Acceptable use

You may view this site and use the enquiry form for genuine partnership purposes. You must not:

• Use the site for any unlawful, fraudulent or deceptive purpose, or in breach of any sanctions or financial crime laws
• Submit false, misleading or impersonating information, or another person’s details without their authority
• Present yourself as PartnerPips, or as a partner, agent or representative of PartnerPips without our written agreement
• Suggest that PartnerPips endorses, guarantees or is responsible for any broker, product, service or outcome
• Copy, scrape, harvest, republish or systematically extract content or data from the site
• Introduce malware, attempt to gain unauthorised access, probe or test the site’s security, or interfere with its normal operation
• Use the site or any material from it to promote guaranteed returns, risk-free trading, or any similar claim

We may suspend or withdraw access to the site if we reasonably believe these terms have been breached.

07Intellectual property

The PartnerPips name, the PartnerPips logo and device, the design, layout, text, graphics and code of this site are owned by us or licensed to us, and are protected by intellectual property law.

You may view the site and print or download extracts for your own internal business use. You may not otherwise reproduce, adapt, distribute, publish or commercially exploit any part of it without our prior written permission. Any third-party names or marks that appear on the site remain the property of their owners.

If you send us feedback or suggestions about the site, you agree we may use them without obligation or payment to you.

08Risk warning

CFDs are complex instruments. Across many jurisdictions a high proportion of retail investor accounts lose money when trading them. Anyone considering trading should understand how these instruments work, consider their objectives and financial situation, and seek independent advice where appropriate.

If you act as an Introducing Broker, affiliate, community operator or marketer, you are responsible for ensuring that everything you publish or communicate is fair, clear and not misleading, carries the risk warnings your jurisdiction and your broker require, and complies with the financial promotion rules that apply to you. PartnerPips does not approve, review or take responsibility for your marketing material.

09Availability and content

We provide this site free of charge and give no guarantee that it will be available uninterrupted, error-free or secure. We may change, suspend or withdraw all or part of it at any time without notice.

We take care over the information we publish, but we do not warrant that it is complete, accurate or current. Content may become out of date, and we are under no obligation to update it. Any reliance you place on it is at your own risk.

10Disclaimer of warranties

To the fullest extent permitted by law, the site and its content are provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory. We specifically disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

Nothing in these terms excludes or limits any warranty or right that cannot lawfully be excluded or limited.

11Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

Subject to that, and to the fullest extent permitted by law, we are not liable to you for:

• Loss of profit, revenue, business, contracts, opportunity, anticipated savings or goodwill
• Loss or corruption of data
• Any trading loss, or any loss arising from a decision to trade or to enter into a partnership
• The acts, omissions, solvency, regulatory standing or conduct of any broker, partner or other third party
• Any indirect or consequential loss, however arising

Where liability cannot be excluded, our total aggregate liability arising out of or in connection with your use of this site is limited to one hundred pounds sterling (£100) or its equivalent, except where a separate written partnership agreement between us provides otherwise, in which case that agreement’s liability terms apply to its subject matter.

12Indemnity

You agree to indemnify us against any claim, loss, liability, cost or expense (including reasonable legal costs) arising from your breach of these terms, your misuse of the site, or any marketing or communication you publish that misrepresents PartnerPips or any broker or partner in our network.

13Changes to these terms

We may revise these terms from time to time. The date at the top of this page shows when they were last updated. Changes take effect when published, and your continued use of the site means you accept them. Please check this page periodically.

14Governing law and disputes

These terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of the jurisdiction in which PartnerPips.com is established, without regard to conflict-of-law principles. The courts of that jurisdiction have exclusive jurisdiction over any such dispute.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it. A person who is not a party to these terms has no right to enforce them.
